The purpose of these general terms and conditions of use (hereinafter referred to as the "GTC") is to determine the rules for using the mobile application "qobook" (hereinafter referred to as the "Application") published by EFFICIENCE-MULTI-MEDIA.
The terms beginning with a capital letter in these GTC, whether used in the singular or plural, shall have the meaning given to them below:
"Application": means the mobile application called "qobook" published and provided by EFFICIENCE-MULTI-MEDIA, giving access to the Services, which is available free of charge in the Apple Store and the Google Play Store to be downloaded by the User on his/her Apple iOS and Android device.
"GTC" means these general terms and conditions of use of the Application.
"Content" means, but is not limited to, the structure of the Application, editorial content, drawings, illustrations, images, photographs, graphic charts, trademarks, logos, acronyms and any other content present in the Application and/or any other element making up the Application.
"Services": refers to the various features and services offered by the Application.
"EFFICIENCE-MULTI-MEDIA": refers to the company EFFICIENCE-MULTI-MEDIA, SAS with a capital of XXX € whose registered office is located at 4 PL DES TROIS CROIX, 61200 ARGENTAN, France.
"User": means any natural person of full age or a minor who has obtained prior authorisation from his/her parents or the person with parental authority to access the Application and the Services.
Access to and use of the Application, the Content and the Services are subject to the User's unconditional acceptance of these GCU. By installing the Application, the User unconditionally and unreservedly accepts the entirety of the GCU defined below. These GTUs therefore constitute a contractual agreement between the User and EFFICIENCE-MULTI-MEDIA. In the event of refusal, the User undertakes not to use or access the Application and its Services.
The purpose of the Application is to provide the User with the following Services:
∙ Scanning or entering the ISBN code on the back of French books;
∙ Access to the qobook database to find the title, author, publisher and year of the work when it is present in the database;
∙
∙ For each book found, the possibility to automatically launch an internet query on themes such as: News, Reader's Reviews, Blogs, Video, Encyclopaedias...
∙ The creation of a personal account allowing access to the "Thematic Discovery" section proposed by the application's partners and to benefit from a personal library (managed as favourites).
This list is not exhaustive and may be modified at any time by EFFICIENCE-MULTI-MEDIA without this responsibility being engaged by anyone.
The Application is offered free of charge to Users, excluding the costs of subscription to the mobile telephone operator, excluding the costs of connection and access to the Internet network and excluding any additional costs charged for loading data.
To access and use the Application, the User must have a compatible telephone or mobile terminal and access to the Internet.
The Application can be downloaded free of charge from the Apple Store and Google Play Store on the following mobile devices
- Apple® Iphone® mobile phone with the iOS operating system iOS 8 and later.
- mobile phone with Android® OS 4.4 and higher
The software version of the Application may be updated from time to time to add new features and services.
Access to the Services available on the Application is available to any User. However, access to certain Services such as the "Thematic Discoveries" section and access to a personal library (managed as favourites).
To create an account, the User provides an email address and chooses a password. An email confirming the email address is sent to him/her afterwards, but access to the application is not hindered by this formality.
The User may request the deletion of his account at any time by activating this feature in the "Settings" section.
The use of the geolocation function of the Application requires the prior express consent of the User to be geolocated. To do so, the User must activate the geolocation function directly in the settings of his/her mobile terminal if he/she so wishes, and accept that the Application may use it. This functionality can be deactivated or activated at any time and at no cost.
By accepting the GPS geolocation function of the mobile phone and the application, the User will be able to access the bookstores around him (this functionality is not yet developed).
EFFICIENCE-MULTI-MEDIA is the exclusive owner of all intellectual property rights relating to the Application and its Content.
None of the provisions of the GCU may be interpreted as an assignment, transfer, sale, concession, licence, loan, lease or authorisation to operate granted directly or indirectly by EFFICIENCE-MULTI-MEDIA to the User on the Application and/or the Services.
The User expressly undertakes:
- not to reproduce permanently or temporarily the Application, in whole or in part, by any means and in any form;
- not to use any software or process to copy the Content without the prior written permission of EFFICIENCE-MULTI-MEDIA.
- not to adapt, modify, translate, transcribe, arrange, compile, decompile, assemble, disassemble, transcode, or reverse engineer all or any part of the Application, the Services and/or the Content;
- not to export the Application, nor to merge all or part of the Application with other computer programs;
- not to make short quotations, analyses and reproductions intended for press reviews as well as other uses expressly authorised by the law within the limits and conditions set by the latter and subject in particular to quoting the names of the authors and the editorial source;
- expressly renounce the use of software or devices likely to disrupt the proper functioning of the Application, or to take any action likely to impose a disproportionate burden on the infrastructures of EFFICIENCE-MULTI-MEDIA ;
- not to extract or re-use, including for private purposes, without prior written authorisation from EFFICIENCE-MULTI-MEDIA, any substantial part or not of the content of the databases and archives constituted by the Application;
- not to set up systems that could hack the Application and/or the Content in whole or in part, or that could violate these TOS;
- to inform EFFICIENCE-MULTI-MEDIA as soon as they become aware of an act of piracy and in particular of any illicit or non-contractual use of the Application and/or the Content, whatever the means of distribution;
- not to sell, rent, sub-license or distribute in any way the Application and/or the Content to third parties.
The personal data that you transmit to qobook is limited to an email address, insofar as you create an account and likely to be kept. The information collected allows us to remember your personal options and the content of the books added to your library.
The statistics generated by the application are anonymous and simply allow us to better understand how qobook is used in order to improve the quality of service and better meet the needs and expectations of our users.
We are committed to providing you with the right to object and withdraw your personal information.
The right to object is understood to be the possibility offered to Internet users to refuse that their personal information be used for certain purposes mentioned at the time of collection.
The right to opt-out is understood to be the possibility for Internet users to request that their personal information no longer appears, for example, on a mailing list.

EFFICIENCE-MULTI-MEDIA undertakes to make its best efforts to secure access, consultation and use of the Application's services. The Application is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of EFFICIENCE-MULTI-MEDIA, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the Application. Maintenance work may be carried out without prior notice to Users.
EFFICIENCE-MULTI-MEDIA is bound by an obligation of means concerning the accessibility, operation and/or availability of the Application and/or Services. EFFICIENCE-MULTI-MEDIA reserves the right to interrupt, suspend or limit access to all or part of the Application and/or Services, in particular due to technical or legal constraints.
The Application may contain hyperlinks to third party websites which are not governed by these TOU.
EFFICIENCE-MULTI-MEDIA has no control over the content of third-party websites referenced by hypertext links. These websites are published by third-party companies independent of EFFICIENCE-MULTI-MEDIA. Consequently, EFFICIENCE-MULTI-MEDIA cannot assume any responsibility for the content, advertising, products, services or any other information or data available on or from these sites.
Consequently, the User acknowledges that he/she alone is responsible for accessing and using these sites. EFFICIENCE-MULTI-MEDIA shall not be held responsible for any damage or loss, whether proven or alleged, resulting from the use of or reliance on the content, goods or services available on these sites.
The information published on the Application is provided strictly and exclusively for information and guidance. EFFICIENCE-MULTI-MEDIA makes its best efforts to keep the Application and Services up to date and to disseminate reliable, legal and up-to-date information.
However, EFFICIENCE-MULTI-MEDIA does not guarantee the integrity, accuracy, completeness, timeliness or other quality of the information published on the Application.
Access to and use of the Application is at the User's own risk.
The Application is provided "as is" and "as available" without warranty of any kind.
It is the responsibility of each User to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack.
The User declares that he/she is aware of and accepts the characteristics and limits of the Internet network and, in particular, the functional characteristics and technical performance of the Internet network; problems related to the connection and/or access to the Internet network and/or websites; problems related to the availability and congestion of the networks; problems related to the failure or saturation of the networks; problems related to transit time, access to information posted online, response times for displaying, consulting, querying or otherwise transferring data; risks of interruption; lack of protection of certain data against possible misappropriation or piracy; risks of contamination by possible viruses circulating on said networks, etc. for which EFFICIENCE-MULTI-MEDIA cannot be held responsible.
EFFICIENCE-MULTI-MEDIA cannot be held responsible:
- in the event of failure, loss, delay or error in the transmission of data which is beyond its control;
- the sending of messages and/or data and/or to a false, erroneous or incomplete address;
- if data are not received for any reason, or if the data received are illegible or impossible to process;
- if the User is unable to access or use the Site, the Application and/or the Services for any reason whatsoever;
- if, for any reason, the connection should be interrupted.
Furthermore, EFFICIENCE-MULTI-MEDIA declines all responsibility in the event of misuse of the terminal and/or incidents related to the use of the terminal when using the Application. EFFICIENCE-MULTI-MEDIA shall in no way be held responsible for any damage of any kind whatsoever caused to Users, their terminals, their computer and telephone equipment and the data stored therein, nor for the consequences that may arise from this on their personal, professional or commercial activity.
The applicable GCU are those in force at the date of connection and use of the Application by the User.
EFFICIENCE-MULTI-MEDIA reserves the right to modify, at any time, all or part of the provisions of the GCU without prior notice or information to Users in order to adapt them to developments in the Services, to technical, legal or jurisprudential developments or when new services are introduced.
Any changes made by EFFICIENCE-MULTI-MEDIA to the GCU will be brought to the attention of Users by simply putting them online. They are deemed to be accepted without reservation by any User who accesses the Application after the said posting. EFFICIENCE-MULTI-MEDIA therefore invites all Users to consult the GTC regularly.
Any new Service incorporating new techniques or new features that improve the quality of the existing Services shall also be subject to these TOU, unless expressly provided otherwise.
